Additional Residential Units (OPA 112)

Background Information

On June 6, 2019 Bill 108 – More Homes, More Choice Act, 2019 received Royal Assent in the Ontario Legislature. This Bill made changes to several pieces of legislation including the Planning Act. The changes related to the Planning Act were proclaimed into force on September 3, 2019 and are now in effect.

Section 16 (3) of the Planning Act was amended and now requires municipalities to authorize the use of two residential units in a single detached dwelling, semi-detached dwelling and rowhouse; as well as the use of a residential unit in a building or structure accessory to a single detached dwelling, semi-detached dwelling or rowhouse. These changes build on the previous second unit framework that was in the Planning Act and look to expand the options municipalities have for providing a range of housing in their communities.

The proposed official plan amendment will update existing policies related to “second units” in the County Official Plan to provide additional flexibility for additional residential units in a manner consistent with the Planning Act. It is important to note that the proposed amendment is sheltered from appeals, however, we will be seeking agency and public feedback to inform the additional residential unit policies in the County Official Plan.

Public Meeting

The County of Wellington has scheduled an electronic public meeting for this matter on October 8, 2020 at 11 am. At this meeting, staff will give a presentation providing an overview of the work completed to date and a summary of the proposed changes to the Official Plan related to Additional Residential Units.
